Course Description

Failure to properly deal with Data subjects’ access rights was the cause of the most complaints to the Data Protection Commission last year (30% of all complaints post-GDPR). In an era where systemic failure to manage such issues could result in a significant fine or litigation, it is vital to understand this issue and manage this process correctly.

This intensive one-day course will offer expert insight and information on important issues when it comes to GDPR, Subject access requests, FOI and the right of access. We will show the similarities between data protection and FOI, exemptions under both, and where they both overlap. We will show you how to effectively deal with requests, with a step by step approach to approaching both FOI and Data Subject Access Requests.

  • work through the DPC’s case studies and cases that have been considered by the courts in Ireland and in Europe.
  • Discussion on the approach of the Data Protection Commission
  • The similarities between Data Protection and FOI generally
  • Step by step approach to DSARs and FOI request
  • The exemptions under both regime
  • How the two regimes overlap
  • How to create an efficient process to deal with requests
  • Differences between the approach of the information Commissioner’s Office and the Data Protection Commission
